TERMS OF SERVICE

OVERVIEW

Welcome to Lydia London.

The terms “we”, “us” and “our” refer to Lydia London. Lydia London operates this website and online store, including the information, content, features, tools, products and services made available through it (collectively, the “Services”).

Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.

These Terms of Service (“Terms”) explain the rules that apply when you visit our website, purchase from us or otherwise use our Services.

Please read these Terms carefully before using our website or placing an order.

By accessing, browsing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you should not use our Services.

Nothing in these Terms affects your statutory rights as a consumer.

SECTION 1 — ACCESS AND ACCOUNTS

You must be legally capable of entering into a binding contract in order to make a purchase from us.

When using our website or placing an order, you may be required to provide information including your name, email address, billing information, payment details and delivery address.

You agree that all information supplied by you is accurate, current and complete.

If you create an account, you are responsible for maintaining the confidentiality and security of your account details and password.

You must notify us if you believe your account has been accessed or used without your permission.

SECTION 2 — OUR JEWELLERY

We make every reasonable effort to display our jewellery accurately, including its colour, size, finish, materials and appearance.

However, colours and appearance may vary slightly depending on your device, screen settings, lighting and photography.

Due to the nature of jewellery, stones, crystals, finishes or other decorative elements may also have minor natural variations between individual pieces.

Product measurements and dimensions are provided as accurately as reasonably possible but minor variations may occur.

Nothing in this section limits your statutory rights. Products supplied by Lydia London must be as described, of satisfactory quality and fit for their intended purpose where required by applicable consumer law.

We reserve the right to update product descriptions, prices or specifications and to discontinue products at any time.

We may also limit the quantities of certain products available for purchase.

SECTION 3 — ORDERS

When you place an order through our website, you are making an offer to purchase the products contained within that order.

Receiving an order confirmation does not necessarily mean that we have accepted your order.

A contract between you and Lydia London is formed when we accept your order and begin processing it for fulfilment, or otherwise confirm acceptance.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

  • a product is unavailable;
  • incorrect pricing or product information has been displayed;
  • we are unable to authorise or verify payment;
  • we reasonably suspect fraudulent activity;
  • delivery restrictions prevent us from fulfilling the order; or
  • an obvious error has occurred.

If we cancel an order after payment has been taken, we will refund the relevant amount using your original payment method.

Please review your order carefully before submitting it.

Your rights to cancel, return or exchange an order are explained in our Refund Policy and are subject to your statutory consumer rights.

Products purchased from Lydia London are intended primarily for personal use and must not be purchased for unauthorised commercial resale.

SECTION 4 — PRICES AND PAYMENT

All prices displayed on our website may be changed at any time before an order is placed.

The price you pay will be the price displayed during checkout at the time you place your order, subject to correction of obvious pricing errors.

Any applicable delivery charges will be clearly displayed during checkout before you complete your purchase.

Where applicable, international customers may be responsible for customs duties, import taxes or other charges imposed by their destination country unless we expressly state that these charges are included.

We may occasionally offer promotional codes, sales or other discounts. Promotions may be subject to additional terms, restrictions and expiry dates.

Unless otherwise stated, promotional offers cannot be exchanged for cash.

You agree to provide accurate and complete billing and payment information.

You must be authorised to use the payment method selected when placing an order.

SECTION 5 — SHIPPING AND DELIVERY

Estimated dispatch and delivery times may be displayed on our website or during checkout.

Delivery dates and timeframes are estimates unless we expressly agree otherwise.

Occasionally, circumstances outside our reasonable control may affect delivery, including postal or courier delays, severe weather, customs processing, industrial action or other disruption.

We will take reasonable steps to deliver your order within the timeframe communicated to you.

Where UK consumer law applies, goods generally remain at our risk until they are delivered into your physical possession or the possession of someone you have identified to receive them on your behalf.

An exception may apply where you independently arrange a carrier that was not offered by us.

If an order appears to have been lost, damaged or incorrectly delivered, please contact us so that we can investigate with the relevant delivery provider.

Nothing in this section limits any rights you may have regarding late, failed, lost or damaged deliveries under applicable consumer law.

SECTION 6 — INTELLECTUAL PROPERTY

Unless otherwise stated, all content made available through Lydia London is owned by, licensed to, or used with permission by Lydia London.

This includes, without limitation:

  • logos;
  • jewellery designs where legally protectable;
  • photographs;
  • videos;
  • graphics;
  • illustrations;
  • written copy;
  • product descriptions;
  • website design;
  • layouts; and
  • other original content.

Our content is protected by applicable copyright, trademark, design and intellectual property laws.

You may use our website for personal and non-commercial purposes only.

You must not reproduce, copy, distribute, modify, republish, sell, commercially exploit or create derivative works from our content without our prior written permission, except where permitted by law.

Nothing in these Terms grants you ownership of, or a licence to use, Lydia London's intellectual property except for the limited personal use of our website described above.

Shopify and any other third-party names, trademarks and logos remain the property of their respective owners.

SECTION 7 — THIRD-PARTY TOOLS

Our website may provide access to services, functionality or tools supplied by third parties.

We may not control these third-party tools and cannot guarantee their continued availability.

Your use of third-party services may also be governed by the third party's own terms and privacy policies.

You should review those terms before using the relevant service.

We may introduce new features, functionality or resources to our website from time to time. Unless otherwise stated, these will also form part of the Services covered by these Terms.

SECTION 8 — THIRD-PARTY LINKS

Our website may contain links to websites or services operated by third parties.

These links are provided for convenience and do not necessarily mean that Lydia London endorses the third-party website or its content.

We do not control third-party websites and are not responsible for their content, availability, security or privacy practices.

If you purchase goods or services through a third-party website, the transaction is between you and that third party.

Please review the relevant third party's terms and policies before completing a transaction.

SECTION 9 — OUR RELATIONSHIP WITH SHOPIFY

Our online store is hosted using Shopify.

Shopify provides the ecommerce infrastructure that enables us to operate our store.

However, purchases made from Lydia London are transactions directly between you and Lydia London.

Shopify is not the seller of Lydia London jewellery and is not responsible for fulfilling your order.

Shopify may process certain personal information in connection with providing its services to us, as explained further in our Privacy Policy.

SECTION 10 — PRIVACY

Your privacy is important to us.

When you use our website or place an order, we may collect and process personal information including your name, contact information, delivery address, order information, payment-related information and information about how you interact with our website.

Our store is hosted by Shopify, which may process certain information on our behalf in order to provide its services.

Other trusted third-party providers may also process information where necessary to provide payment, delivery, marketing, analytics or other services.

Please read our Privacy Policy for full information about how your personal data is collected, used, stored and protected and about your rights.

SECTION 11 — REVIEWS, FEEDBACK AND USER CONTENT

If you submit a review, photograph, comment, suggestion, feedback or other content to Lydia London, you confirm that you have the necessary rights to submit that content.

Where you voluntarily submit content for publication, you grant Lydia London a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content in connection with operating and promoting our business, subject to applicable law and our Privacy Policy.

You must not submit content that:

  • infringes another person's intellectual property rights;
  • contains unlawful, defamatory, abusive or obscene material;
  • contains malicious software;
  • intentionally contains false or misleading information; or
  • impersonates another person.

You remain responsible for content that you submit.

We reserve the right to remove or decline to publish content where we reasonably believe it breaches these Terms or applicable law.

SECTION 12 — ERRORS AND INACCURACIES

We take reasonable care to ensure information on our website is accurate.

Occasionally, however, information may contain typographical errors, inaccuracies or omissions relating to matters including:

  • product descriptions;
  • prices;
  • promotions;
  • availability;
  • delivery charges; or
  • delivery estimates.

We reserve the right to correct errors or update information at any time.

If an error materially affects an order that you have already placed, we will contact you where appropriate and explain your available options.

Nothing in this section affects your statutory consumer rights.

SECTION 13 — PROHIBITED USES

You may use our website only for lawful purposes.

You must not use the Services:

  • for unlawful or fraudulent purposes;
  • to violate applicable laws or regulations;
  • to infringe our intellectual property rights or those of another person;
  • to transmit malicious software, viruses or harmful code;
  • to harass, abuse, threaten or defame another person;
  • to intentionally transmit false or misleading information;
  • to impersonate another person or organisation;
  • to collect personal information about others unlawfully;
  • to send spam or unauthorised advertising;
  • to interfere with the security or normal operation of our website;
  • to attempt unauthorised access to our systems; or
  • to copy, scrape or commercially exploit substantial parts of our website without permission where such activity is prohibited by law.

We may restrict or terminate access to our Services where we reasonably believe these Terms have been seriously breached.

SECTION 14 — SUSPENSION OR TERMINATION

We may suspend or terminate access to all or part of our Services where reasonably necessary, including where there has been misuse of our website, fraudulent activity or a serious breach of these Terms.

Termination does not affect rights or obligations that arose before termination.

Any provisions that by their nature are intended to continue after termination will remain in effect.

SECTION 15 — WARRANTIES AND CONSUMER RIGHTS

Nothing in these Terms excludes or limits rights that cannot legally be excluded or limited.

Where you are purchasing as a consumer, your jewellery must meet the standards required by applicable consumer protection law.

This includes requirements relating to goods being of satisfactory quality, fit for purpose and as described.

Information made available elsewhere on our website for general informational purposes should not be treated as professional, medical, financial or other specialist advice.

Any descriptions relating to the traditional, symbolic or spiritual meanings associated with gemstones or crystals are provided for general interest only and should not be interpreted as medical or therapeutic claims.

SECTION 16 — LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits our liability where doing so would be unlawful.

In particular, nothing in these Terms limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • any other liability that cannot legally be excluded or restricted.

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

If you are purchasing as a consumer, we are not responsible for business losses, including loss of profits, revenue, business opportunity or anticipated savings arising from use of products purchased primarily for personal use, except where applicable law provides otherwise.

We are not responsible for losses caused solely by circumstances outside our reasonable control where permitted by law.

Nothing in this section affects your statutory rights.

SECTION 17 — INDEMNITY

Where permitted by law, if you use our Services for business purposes or in a manner that breaches these Terms, you may be responsible for reasonable losses suffered by Lydia London as a direct result of that breach.

Nothing in this section applies in a way that would unfairly restrict the statutory rights of consumers.

SECTION 18 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as removed or modified to the minimum extent necessary.

The remaining provisions will continue in full force and effect.

SECTION 19 — WAIVER AND ENTIRE AGREEMENT

If we do not immediately exercise a right available to us under these Terms, this does not mean that we have waived that right.

These Terms, together with the policies expressly referred to within them, form the agreement between you and Lydia London regarding use of our Services.

Nothing in this section limits any representations, rights or remedies that cannot lawfully be excluded.

SECTION 20 — ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent where such consent is legally required.

We may transfer our rights or obligations under these Terms to another organisation, for example as part of a restructuring, sale or transfer of our business.

Where required by law, we will notify you of any transfer that materially affects your rights.

SECTION 21 — GOVERNING LAW

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply to you based on where you live.

If you are a consumer resident in another part of the United Kingdom, you may also have the right to bring proceedings in the courts applicable to the part of the UK in which you live.

Nothing in these Terms removes any mandatory rights available to consumers under applicable law.

SECTION 22 — HEADINGS

Section headings are included for convenience only and do not affect the interpretation of these Terms.

SECTION 23 — CHANGES TO THESE TERMS

You can review the latest version of these Terms on this page at any time.

We may update these Terms from time to time to reflect changes to our business, Services, policies or applicable laws.

The version published on our website at the time you place an order will generally apply to that order unless applicable law requires otherwise.

Where a change materially affects users and the law requires notification, we will provide appropriate notice.
